1. Agreement to these terms
Joe is provided by Day Won, LLC (“Day Won,” “we,” “us,” or “our”). By downloading, accessing, or using Joe, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use Joe.
2. What Joe provides
Joe is an iPhone alarm and morning-planning app. Depending on your version and permissions, features may include alarms, custom tones, wake-up routines, text briefings, weather information, calendar context, and commute or leave-by estimates. Features may change as the app develops.
3. Alarm reliability and important responsibilities
Joe is designed to assist with waking and planning, but no alarm or notification system is guaranteed. Delivery can be affected by device power, volume, Focus modes, permissions, iOS behavior, hardware issues, network availability, or settings outside Day Won's control.
You are responsible for confirming that alarms, device volume, permissions, charging, and backup arrangements are appropriate. Do not rely on Joe as your only alert for emergencies, medication, caregiving, travel, employment, legal deadlines, or any safety-critical obligation.
4. Eligibility and lawful use
You may use Joe if you can lawfully agree to these terms. If you use Joe for a child or another person, you are responsible for supervising that use, managing permissions, and approving purchases. You may not misuse Joe, interfere with its operation, attempt unauthorized access, reverse engineer it except where law permits, or use it unlawfully.
5. Permissions and Apple services
Some features require optional iOS permissions, including notifications, calendar access, or location. You control these permissions in iOS Settings. Joe also depends on services supplied by Apple, including the App Store, StoreKit, calendar frameworks, weather services, MapKit travel estimates, and iOS notification or alarm capabilities. Those services are subject to Apple's terms and availability.
6. Joe Free, Joe Plus, and free trials
Joe may offer free and paid features. Current pricing, billing period, trial terms, and renewal details will be displayed by Apple before you confirm a purchase. Unless cancelled at least as required by Apple, subscriptions may renew automatically and your Apple ID may be charged.
You can manage or cancel a subscription in your Apple ID subscription settings. Billing, refunds, and purchase restoration are handled under Apple's applicable App Store rules. Deleting Joe does not automatically cancel a subscription.
7. License and ownership
Subject to these terms and Apple's App Store rules, Day Won grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Joe on Apple devices you own or control. Joe—including its software, design, text, artwork, characters, trademarks, and other content—is owned by Day Won or its licensors and protected by law.
8. Your content and feedback
You retain responsibility for routine items and other information you enter into Joe. Do not enter unlawful or harmful content. If you voluntarily send ideas or feedback, you allow Day Won to use them without restriction or compensation, while we remain responsible for handling any personal information under the Privacy Policy.
9. Availability, updates, and termination
We may update, add, limit, or discontinue features and may require a supported version of iOS. We may suspend access when reasonably needed for security, legal compliance, maintenance, or misuse. You may stop using Joe at any time by deleting the app, but you must separately cancel any active subscription through Apple.
10. Disclaimers
To the fullest extent permitted by law, Joe is provided “as is” and “as available.” Day Won disclaims warranties that are not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Weather, calendar, and other third-party information may be delayed, incomplete, or inaccurate.
Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Day Won and its members, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill arising from Joe. Day Won's total liability for claims related to Joe will not exceed the greater of the amount you paid for Joe during the twelve months before the claim or fifty U.S. dollars (US $50).
These limits do not apply where prohibited by law or to liability that cannot legally be limited.
12. Governing law
These terms are governed by the laws of the state in which Day Won, LLC is organized, together with applicable United States federal law, without regard to conflict-of-law principles. Mandatory consumer protections in your place of residence remain unaffected.
13. Changes to these terms
We may update these terms as Joe changes or legal requirements evolve. We will post the revised terms here and update the effective date. Your continued use after an update means you accept the revised terms, to the extent permitted by law.
14. General
If any provision is unenforceable, the remaining provisions remain in effect. A delay in enforcement is not a waiver. These terms and the Privacy Policy are the entire agreement concerning Joe unless another written agreement expressly applies. You may not transfer these terms without our consent; Day Won may transfer them as part of a merger, financing, reorganization, or sale of assets.
